By beginning to use NOZOMI Travel's services, you acknowledge that you have read, understood, and agree to these Terms of Use. If you do not agree to these Terms of Use, you may not use NOZOMI Travel's services.

1. Your Relationship with NOZOMI Travel
1.1 These Terms of Use govern your use of the NOZOMI Travel Platform (.rezio.shop) and any other online or offline services we provide, as well as your travel purchases through NOZOMI Travel (collectively, the "NOZOMI Travel Services").
1.2 These Terms of Use constitute a binding contract between you and NOZOMI Travel. By using NOZOMI Travel's services, you are subject to any additional terms and conditions associated with the services, as updated from time to time, and NOZOMI Travel's Privacy Policy, all of which are incorporated into these Terms of Use by reference.
1.3 NOZOMI Travel may modify or update these Terms of Use at any time without prior notice, as required by applicable law or as we deem necessary. If there are any changes to these Terms of Use, we will post the latest version of these Terms of Use on our website (.rezio.shop) and indicate the date of the most recent update. Your continued use of NOZOMI Travel's services after these Terms of Use have been updated will constitute your agreement to the updated Terms of Use. Please review the latest version of these Terms of Use whenever you use NOZOMI Travel's services.

2. NOZOMI Travel's Services
2.1 NOZOMI Travel's Services provide you with an easy and convenient way to purchase tours, transfers, tickets, and other travel experiences offered by NOZOMI Travel or our partner third-party suppliers ("Suppliers") through the NOZOMI Travel platform. You understand and agree that the specific Services you purchase are for personal use only and not for commercial purposes. To the maximum extent permitted by law, you also agree that we reserve the right to change, suspend, or terminate any Service from time to time, impose restrictions, limitations, or amend the terms of any Service, or restrict your use of some or all of the Services without prior notice to you. 
2.2 You may be required to pay fees to suppliers for your use of NOZOMI Travel's services, and you will be required to abide by the suppliers' terms and conditions. You understand and agree that you are fully responsible for these fees and agree to pay them and abide by their terms and conditions.
2.3 We will make every effort to maintain the operation of NOZOMI Travel's services and the NOZOMI Travel Platform, but we do not guarantee that NOZOMI Travel's services and the NOZOMI Travel Platform will operate normally at all times or will not be affected by external factors. You agree that we have the right to deny you access to the NOZOMI Travel Platform or use of NOZOMI Travel's services, and you agree that we have the right to change, suspend, interrupt, or terminate NOZOMI Travel's services, website, or NOZOMI Travel Platform.

3. Platform Content
3.1 "Platform Content" as referred to in these Terms of Use means all materials presented or used by us on the NOZOMI Travel Platform, including but not limited to text, photos, images, videos, illustrations, videos, audio, data, code, and other materials. You understand and agree that all Platform Content is the exclusive property of NOZOMI Travel or those who have authorized NOZOMI Travel to use it and is protected by applicable intellectual property laws. NOZOMI Travel reserves the right to change, modify, or remove any Platform Content at any time without prior notice to you.
3.2 Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable license to use and access the NOZOMI Travel Platform. We may revoke this license at any time without prior notice to you. You agree to comply with applicable intellectual property laws and other applicable regulations and to use or access the Platform Content only for personal, non-commercial, and entertainment purposes. Under no circumstances will you use, reproduce, translate, transmit, disseminate, sell, transfer, create derivative works based on, or otherwise exploit any Platform Content in any manner that infringes upon the rights of NOZOMI Travel or those who have authorized NOZOMI Travel to use it. You are also prohibited from copying, storing, or downloading any Platform Content in any form. Furthermore, you agree that your use or access of any Platform Content is at your own risk. To the fullest extent permitted by law, we assume no liability to you for any Platform Content, including, but not limited to, any errors or omissions in the Platform Content. You will be solely responsible for any damages or losses incurred by any person as a result of your use or access of any Platform Content.
3.3 You understand and agree that when you use or access Platform Content, we may not be able to know the identities of other third-party users with whom you may interact, or to predict or control their behavior. Therefore, we cannot guarantee the authenticity and accuracy of the content, information, or data provided by other third-party users on the NOZOMI Travel Platform.

4. Information You Provide
4.1 You agree and authorize us to use your personal information in accordance with NOZOMI Travel's Privacy Policy.
4.2 To collect your feedback and improve NOZOMI Travel's services, you agree to accept traveler review invitations via text messages, emails, or on the NOZOMI Travel Platform. You may decide whether to submit a traveler review. Once we receive your traveler review, we have the right (but not the obligation) to upload it to the relevant pages of the NOZOMI Travel platform to share and publicly share your service satisfaction and opinions. You must ensure that your traveler review is not misleading and does not contain inappropriate, defamatory, threatening, abusive, or other offensive language. It should not include personal information about you or other third parties, content that is not a traveler review, or other content that violates any law or regulation. 
4.3 You understand and agree that when you use NOZOMI Travel's services, the traveler reviews you provide, including but not limited to text, photos, images, and videos, may be used by NOZOMI Travel, its suppliers, or users of the NOZOMI Travel platform, regardless of whether such traveler reviews meet copyright requirements under applicable intellectual property laws. Therefore, by providing traveler reviews to NOZOMI Travel, you irrevocably grant: (a) a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to NOZOMI Travel or its suppliers to reproduce, re-format, excerpt, modify, translate, create derivative works from, and otherwise use such reviews, including but not limited to promoting them in any media formats and through any media channels; and (b) a non-exclusive license to users of the NOZOMI Travel platform to access, use, reproduce, create derivative works from, and otherwise make fair use of such reviews through the NOZOMI Travel platform for non-commercial purposes. However, your authorization does not affect your ownership of the information you provide, unless otherwise agreed in writing. 
4.4 You warrant that all materials you provide (including but not limited to text, photos, images, and videos) do not violate any laws or regulations, do not infringe the rights of any third party, and that NOZOMI Travel's use of such materials will not infringe the rights of any third party. You understand that you are solely responsible for all materials you provide, and NOZOMI Travel assumes no responsibility for any errors or omissions therein.
4.5 You expressly agree that we may remove any materials you provide from the NOZOMI Travel Platform at any time at our sole discretion.

5. Your Commitment
5.1 You shall use NOZOMI Travel's services or the NOZOMI Travel Platform solely and in accordance with these Terms of Use. You shall bear sole legal responsibility for all actions you take in connection with your use of NOZOMI Travel's services or the NOZOMI Travel Platform. 
5.2 You agree to the following:
(a) You will not copy, reproduce, distribute, publish, display, transmit, or publicly broadcast any part of NOZOMI Travel's Services without our prior written authorization, including but not limited to any of the following actions without our prior express consent: (i) modifying, defacing, or circumventing any licensed software used in NOZOMI Travel's Services; and (ii) using any trademarks, service marks, design marks, photos, or other content belonging to us or obtained from NOZOMI Travel's Services.
(b) You will not circumvent, compromise, or interfere with any security measures used to control access to NOZOMI Travel's Services, retrieve or mine content from NOZOMI Travel's Services, or use NOZOMI Travel's Services in any manner inconsistent with your personal use. 
(c) Except as permitted by these Terms of Use or otherwise, you may not perform, cause, permit, or authorize the translation, reverse engineering, disassembly, or hacking of any aspect of NOZOMI Travel's Services (including any Service Content accessible through NOZOMI Travel's Services), or attempt any of the foregoing, or attempt to use any part of NOZOMI Travel's Services other than as designed.
(d) Unless we provide embedding methods for NOZOMI Travel's Services or Service Content, you may not use, display, simulate, frame, or utilize framing techniques to expose NOZOMI Travel's Services (including any part accessible through NOZOMI Travel's Services) through another application or website. You may not access, damage, or use any undisclosed areas of NOZOMI Travel's Services, computer systems and equipment of NOZOMI Travel (and NOZOMI Travel's hosting company), or the technical reception systems of our Internet service providers. 
(e) You may not access, damage, or use any unlisted areas of NOZOMI Travel's services, NOZOMI Travel's (and NOZOMI Travel's hosting company's) computer systems and equipment, or the technical reception systems of our internet service providers.
(f) You may not harass, abuse, harm, or support the harassment, abuse, or harm of any other individual or group (including our employees or other users).
(g) You may not provide false personal information, create a false identity, or impersonate any other person or group in any way.
(h) You may not collect or attempt to collect personal information from other users.
(i) You may not restrict or inhibit anyone from using NOZOMI Travel's services, disclose personal information about any third party on or obtained from NOZOMI Travel's services without the third party's consent, or collect information about any user.
(j) Except as expressly permitted in these Terms of Use, you may not use NOZOMI Travel's services to contact or engage in any commercial advertising or data collection. 
(k) You will not engage in any fraud, violate the information security of the NOZOMI Travel Platform, hack other users’ passwords, transfer or illegally store data, or perform any other illegal activities.

6. Order Confirmation and Refund Policy
6.1 Through the NOZOMI Travel platform, you can purchase tours, transfers, tickets, and other travel experience-related services offered by NOZOMI Travel or its suppliers in a specific currency. While some orders are completed immediately upon order placement, others are subject to confirmation by NOZOMI Travel or its suppliers. You agree to receive notification of successful bookings via SMS, email, or mobile app. You understand and agree that the timelines for responding to booking results stated on the NOZOMI Travel platform are for reference only. You also agree that the time it takes to confirm your booking is subject to change based on actual circumstances.
6.2 NOZOMI Travel reserves the right to change or adjust the prices and fees of tours, transfers, tickets, and other travel experience-related services offered by NOZOMI Travel or its suppliers at any time. Changes may be announced via SMS, email, website, or mobile app. Your use of NOZOMI Travel services after such change notification constitutes your agreement to and acceptance of the changed prices and fees. 
6.3 You agree that NOZOMI Travel may, at its sole discretion, refuse or cancel any reservation or order that may violate these Terms of Use.
6.4 You agree that you must pay for your order using a payment method accepted by us. You understand and agree that we have no obligation to process or fulfill your order until you have completed payment in accordance with our payment instructions. Unless otherwise provided in these Terms of Use, all amounts paid by you are non-refundable.
6.5 If the services you purchase are provided by a supplier other than NOZOMI Travel, the supplier will be solely responsible for accepting or rejecting your reservation or order and for providing all related services. If you have any questions about a supplier's services, you should first contact the supplier for direct information; however, you may also contact NOZOMI Travel, and we will attempt to resolve the issue with the supplier.
6.6 You understand and agree that any supplier's services may incur additional taxes or fees, depending on the circumstances, and you may be obligated to pay any such fees directly to the supplier or tax authorities. Although we request suppliers to provide us with the most current and accurate terms and conditions, restrictions, and pricing for their services, NOZOMI Travel cannot guarantee that all content displayed on the NOZOMI Travel Platform is accurate at all times. If your order is cancelled by a supplier, NOZOMI Travel will notify you promptly and by reasonable means.
6.7 If you contact us or the supplier to cancel your reservation within the cancellation period stated on the NOZOMI Travel Platform at the time of booking, upon successful cancellation and receipt of our notification, or if the service you purchased is cancelled in accordance with the terms and restrictions set by us or the supplier, the amount you paid will be refunded using the same payment method. You fully understand and agree that the refund amount you may receive may differ from the original payment amount due to exchange rates and any processing fees or service charges imposed by credit card or payment service providers. 
6.8 How to Use an Electronic Voucher
6.8.1 If you purchase tours, transfers, tickets, or other travel experience-related services through the NOZOMI Travel platform, after successfully booking, in addition to providing physical tickets or other circumstances, you will receive a text message or email confirming your order. This will include your order number and an electronic voucher for the services you purchased (the "E-Voucher"). You may print your Electronic Voucher for your own use.
6.8.2 You understand and agree that you must comply with any additional terms and restrictions imposed by NOZOMI Travel or the supplier regarding the use of the Electronic Voucher, including but not limited to: you must appear in person and on time at the designated meeting point designated by NOZOMI Travel or the supplier within the validity period of the Electronic Voucher and present any documents or information requested by NOZOMI Travel or the supplier (such as photo identification, your order number, and your Electronic Voucher). If you fail to meet the terms and restrictions imposed by NOZOMI Travel or the supplier, you may not be able to redeem the services listed in the Electronic Voucher or request a refund. 6.8.3 You understand and agree that if your e-voucher or booking number is lost or stolen, NOZOMI Travel or the supplier has no obligation to reissue the e-voucher or provide you with redemption rights for the services represented by the e-voucher. Furthermore, if you attempt to redeem a voucher unlawfully, for example, because you are under the legal age to use the services represented by the e-voucher, NOZOMI Travel or the supplier may refuse to redeem the e-voucher without refund.

7. Limitation of Liability
7.1 You understand that Platform Content may be provided by suppliers and agree that we make no representations or warranties regarding the accuracy of Platform Content. You agree not to hold us responsible for any Platform Content provided by suppliers.
7.2 You agree that any content you communicate to or transmit to the NOZOMI Travel Platform is not confidential and that your communications may be read or intercepted by others. You understand and acknowledge that no confidential, fiduciary, or other legal relationship of a cooperative nature is established between you and us. 
7.3 To the maximum extent permitted by law, you agree that NOZOMI Travel and our directors, officers, officers, employees, and agents shall not be liable to you for any direct, indirect, special, incidental, punitive, exemplary, or consequential damages arising from your breach of these Terms of Use, your use of the NOZOMI Travel Platform, or any other negligence.
7.4 To the maximum extent permitted by law, you agree that if you are dissatisfied with our services, your sole and exclusive remedy against us is to discontinue using our services. In any event, our liability to you for any damages will be limited to the total fees paid by you to us in the twelve months prior to the initial claim.

8. Indemnification
8.1 You agree to indemnify and hold harmless NOZOMI Travel and our directors, officers, directors, employees, and agents from any and all claims brought by any third party, including, but not limited to, all legal costs, attorneys' fees, settlement costs, and other losses, arising from any third-party claim resulting from any violation of these Terms of Use or infringement of the intellectual property rights or other rights of any third party by you or anyone using your NOZOMI Travel membership account while accessing the NOZOMI Travel platform or using NOZOMI Travel services.
8.2 In the event of a claim brought by such third party, NOZOMI Travel may require you to defend any claim or action and to negotiate a settlement. However, you may not take any action that may prejudice our rights without our prior written consent.

9. Termination
9.1 These Terms of Use will continue to apply between you and NOZOMI Travel until terminated by us. If you breach any provision of these Terms of Use, or if we deem it necessary in our sole discretion, we reserve the right to immediately terminate or suspend your use of NOZOMI Travel's services, access to the NOZOMI Travel platform, or your membership account without prior notice.
9.2 If these Terms of Use are terminated in accordance with Section 9.1, you agree that, to the fullest extent permitted by law, we will have no obligation or liability to you and may cancel any orders you place prior to termination without refund.
9.3 You acknowledge and agree that any provisions of these Terms of Use, by their nature, may survive termination, including, but not limited to, limitations of liability.

10. Visas and Insurance
10.1 Regardless of your nationality or travel destination, you should be aware of the current entry regulations in effect at your destination. As visa and medical requirements may change without notice, we recommend that you confirm the current regulations before traveling.
10.2 For your own benefit, we recommend that you purchase comprehensive travel insurance before traveling.

11. Dispute Resolution
You agree that the highest court in the jurisdiction of NOZOMI Travel's place of business shall be the first instance court for any disputes or controversies arising from your use of NOZOMI Travel's services.

12. Other Matters
12.1 If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
12.2 We may assign these Terms of Use or any rights and obligations arising under them, and may delegate any of our obligations under them to any third party. You may not assign these Terms of Use or any rights and obligations arising under them, directly or indirectly, without our prior written consent.
